Problems And Countermeasures In Water Administrative Law Enforcement

Water administrative law enforcement is an important part of water administration,is the key to water work,also an important part of the administrative law enforcement system.Water control in accordance with the law is the eternal theme of every water administrative law enforcement worker.Nowadays,the water administrative law and regulation system has been basically completed,and the water administrative law enforcement has been improved day by day.However,in the current research,it is rare to interpret the dilemmas and problems in water administrative law enforcement from the perspective of law,and there is a lack of empirical analysis as the method and judgment document as the perspective of the model of water administrative law enforcement activities.The vitality of law lies in practice.The author tries to find a breakthrough through through empirical research,which has important theoretical significance and practical value for practical departments and scholars.In addition to the introduction and conclusion,the article is divided into four parts.The first part outlines the origin and the way of the study,describes the current research situation of water administrative law enforcement and combs the existing viewpoints,puts forward the method of empirical analysis as the research approach and introduces the process and results of sample selection.The second part of the macro-analysis,based on 236 judgment documents as samples,describes the characteristics and laws of water administrative law enforcement cases through chart form.The third part of the micro perspective,mainly in-depth analysis of the case of losing the water administrative authority,which reflects the problems in water administrative law enforcement are summarized,the causes of in-depth analysis.The fourth part of the solution,around the specific water administrative law enforcement problems found in practice,targeted to find the above predicament countermeasures and suggestions.Through the in-depth analysis of the sample judgment documents,the author finds that the problems of inaccurate application of laws and regulations,improper procedures,unclear evidence,abuse of discretion and inadequate enforcement of law are reflected in the process of water administrative law enforcement.The quality of water administrative law enforcement personnel is uneven,the relative person is not cooperated,the water administrative laws and regulations are not sound,the joint law enforcement system is not formed,water illegal cases difficult to obtain evidence,internal and external supervision and restriction mechanism has not played a good role in water administrative law enforcement factors that bring difficulties.After summing up the above problems and analyzing the reasons,referring to the existing theories and viewpoints,the latest policies and systems,and the law enforcement experience of the staff working in the grass-roots water conservancy departments,the author proposes that the law enforcement departments should be encouraged to administer the water administration according to law,ensure the legitimacy of the procedure of the water administration law enforcement,and improve the evidence in the water administration law enforcement.Suggestions on how to use and rationally use the discretion,how to improve the water administrative linkage law enforcement and how to strengthen the new mechanism of water administrative law enforcement and supervision.After resolving these difficulties,water administrative law enforcement will surely make further progress,make water administrative law enforcement and water administration go on smoothly,maintain the normal order of water affairs,administer water according to law,and ensure water safety.
