For a long time, the peasantry's problems have become a hot of society in the circle of academy because of various reasons. Among these problems, peasantry's right especially right of equality is the focus of research. In this paper, equality is the unification of equality of form and equality of essence, but the equality of form is the first. The equality includes not only the equality on enforcement of law but also the equality on content of law. Furthermore, the equality is relative and the different treatment should be rational. The peasantry's equal right is the same right that the peasantry should enjoy as the member of citizenry with other citizens, on every aspect of social life such as politics, economy, culture and education, and every aspect of social life. Its essence is that the peasantry should be treated equal in these fields based on the citizenship. In real life, the peasantry's right of equality is not enough, and the reason includes such as the thought of idea, the tradition of legal, the national policy, the system of city and countryside, the social organization, the land system, and the mechanism of right protection. The fundamental approach to solve this problem lies in taking measures to protect the peasantry's legitimate rights and interests from the perspective of constitution, to give the peasantry real equality, to respect the basic right of the peasantry as the citizenry, to give the peasantry national treatment, in order to realize the liberation of the law and the fundamental transition from the peasantry to the citizenry which means"from status to contract", so as to bath in the sunshine of equality.
