After World War II, Japan has formulated the democratic and peaceful "Education Basic Law" under the instruction of US Army, following called the Old Education Basic Law. This law was considered as constitution which stipulated Japanese educating theory and spirit, instructing Japanese educational reform and development. Under the basic educational theory instruction of the Old Education Basic Law "the educational opportunity is equal", "respects other people" and so on, Japan has obtained considerable development in education after war.In the 1970s, Japan developed rapidly and became a great economic country in the world. As its huge economic country's establishment in the world, Japan displayed its ambition to become a political power unceasingly, attempted to move toward the political power from the economic giant. In order to adapt this political strategy demand, some right - wingers proposed that the old education fundamental law could not adapt the new times' request, and they had to revise the old education fundamental law to adapt educational reform development. Moreover, as Japan educational reformed, Japan's school edition, the family education and the moral education came out many problems. There were many serious problems in the school education, such as "the class and grade collapses", "the scholarship crisis", "the campus to bully", "does not ascend the school" and so on; In the family the violence frequently appeared; School moral education flaw seriously. Some Japanese political figures believed the reason was that Japanese Education Basic Law couldn't adapt the new times' reform and development, and must revise the education basic law to instruct educational reform. From 2000, the Japanese Ministry of Education established the Educational Reform National Assembly, then the education basic law revision was put into the agenda. Hereafter, although Japan community opposite to revise education basic law unceasing, on December 22, 2006, Japanese new "Education Basic law" became 18 year legal 120th announcement implementation.New "Education Basic Law" has made the new stipulation to education idea, increasing "love motherland and hometown" to substitute "respects other people", and "the seek truth and peace". Loving the motherland and hometown deeply becomes the basic theory of Japanese New Education Basic Law. For one country have started aggressive war such as Japan, this education idea would easily lead Japan to the path to militarism, statism and right deviation principle.From the angle of establishing and revising the new and old "Education Basic Law", through the research and analysis the process of education basic law, and contrastive analysis the content, the function and the significance of the new and the Old Education Basic Law, we can find the different education theory and effect between the new and the Old Education Basic Law to forward-looking searches and indicates Japanese educational reform direction and tendency.The present paper mainly includes the following parts:Introductory remarks, intention of this paper, research value, Japanese and domestic present research situation as well as main concept.The first chapter, through analyzing the legislative background of the Old Education Basic Law, the content and the objective as well as the postwar Japanese educational reform development, analyzes the instructional function of the Old Education Basic Law to Japanese educational reform.The second chapter, through analyzing the present educational problem, Japan faces and the history and process of revising the old law; Discusses the Japanese education theory transformation.The third chapter, through analyzing the content of the new and old Education Basic Law, thus furthers comparative analysis the different idea between the new and old law manifests.The conclusion, promulgates the basic theory which the new education fundamental law contains, and the effect the New Education Basic Law to Japanese educational reform, thus tries to find the tendency of Japanese educational reform.
