Research On Japanese Ocean Basic Law

The implement of The United Nations Convention on the Law of the Sea makes new order be founded and changes the world policy, which develops new ocean revolutions in the world. Japan makes efforts to obtain more ocean benefits and ensure better status from ocean disputes with around countries. For the complicated ocean problems, the relative people from Japan realize existing ocean law out of place on nowadays conditions and advise government constitute new ocean basic law rapidly. Japanese Ocean Basic Law is approved in Japan in April, 2007 and implemented on 20, July. Japanese Ocean Basic Law is an important act in ocean policies, the influences and revelations from Japanese Ocean Basic Law is worth paying more attentions for our country.Firstly, the background of Japanese Ocean Basic Law is introduced from three facets and the forming process is expatiated in the 1st chapter. Secondly, the content of Japanese Ocean Basic Law is analysed in details from purpose, policy, basic plan and foundation of administrating office in the 2nd chapter. Thirdly, the impacts of Japanese Ocean Basic Law on the ocean disputes from China and Japan is the first important contents discussed in this paper. The ocean disputes include island dominion, ocean boundary and ocean energy. Our country must take corresponding measures to do with the impacts. At Last, in the 4th chapter, the revelation from Japanese Ocean Basic Law is the second important contents. Some similarities and differences of ocean managements are concluded by use of contrast and analysis, which shows the beneficial revelations from advanced ocean management principle, furthermore, some advices about imposed ocean management are put forward.The contents for this paper is helpful to see clearly the attitude about ocean dispute possible measures from Japan, and condutive to the staleinate of the Sino- Japan maritime interests dispute by the reality of inspiration and guiding significance. At the same time, it is helpful to use for reference to advanced management ways from Japan, which helps to turn China into a powerful ocean country.
