Education for ethnic minorities (EFEM) is an important component of China's education cause, also is an important content of the ethnic minority work. Over the past 50 years, China's EFEM has obtained the remarkable achievement. Along with it, educational legislation for ethnic minorities (ELFEM) has developed unceasingly, grows out of nothing, from few to many, starts to lay the preliminary foundation perfectly. But, looked from China's ELFEM present situation and the legislation practice that, ELFEM seem to lag behind the request of EFEM; formally, educate laws for ethnic minority do not to have formed entire system, there is not independent, systematic, complete special laws of education for ethic minorities, On content, legislation backward in technique, is divorced from reality, copies average legislation, and not completely embody the particularity of EFEM. This causes laws of EFEM not be able to play role of guaranteeing and promoting for EFEM. The thesis starts with the basic concept of EFEM, and demonstrates the basic theory of ELFEM, set forth the problem of ELFEM, and then put forward suggestions to perfect.
