Chinese minority education is an important part of the national policy. It is also one of the basic contents of education work in our country. So the rise and fall of the ethnic education decide the success or failure of Chinese Education. It is more than 60 years of founding the new China, since the reform and opening up, the level of education in China has been raised. However, the education in China still exist certain problems. In order to changing this situation, we have to rely on the social system. It is a good method to result those minority education’s problems that bring minority education into the rules of law.There are five parts in this paper.The first part summary the research content in general, point out the concept of ethnic education and ethnic education legislation. From the crowd, ethnic groups, and members of ethnic minorities in national regions. From the geography, ethnic minority areas, the western minority areas and concentration areas of ethnic minority. Form is mainly ethnic minority culture and education, and at the same time it should also include general education. And national education legislation is dedicated for ethnic minority education problem of legislative activities. Including the level of ethnic minority education legislation and the local level of local education legislation of ethnic minorities. This paper also explain the meaning of researching this paper, and summarized the current research status of ethnic and ethnic legislation, then puts forward the view firmly that is only to bring the ethnic education into the rule the law, the problem of ethnic and national education can be solved.The second part first explains the concept and the theory source of rule by law then point out the important function and meaning of this theory. Then, further demonstrates of the necessity and importance of rule by law.The third part through reviewing the development of ethnic education legislation in China, then put forward the solutions of bring the ethnic education into the rule the law. This part also expounded the present situation of the ethnic education legislation in our country, then pointed out the advantage and necessity of the ethnic education legislation. At last, this part discusses the achievement of ethnic education legislation in China, and then explained the scientificalness and rationality of ethnic education legislation.The fourth parts explain the main problems of Chinese ethnic education legislation through the analysis of Chinese ethnic education legislation situation. First from the overall point of view, analyses the missing of ethnic legislation in China. Then, from the local point of view, analysis the limitations of local ethnic education legislation. Once again, from the perspective of the concrete, pointed out the deficiency of ethnic education in our country. This part does a comprehensive analysis for the later countermeasures.Part five put forward some countermeasures and suggestions to improve the development of ethnic education legislation. This article put forward specific countermeasures on the basis of predecessors’ research results and using the interdisciplinary vision. First of all, optimizing the content of the national education legislation. Identifying the contents from five aspects: the connotation of national education, the status, tasks and principle of national education, the related rights and obligations of national education, the way of inheritance and protection the national traditional culture and the responsibility of contrary to national education law. Then, improving the level of national education legislation, doing a good job in planning and forecasting of national education legislation, strictly regulating the designation and written language of the current national education regulations. Finally, strengthen the supervision and theoretical research of national education legislation, improving the supervision mechanism and strengthen the theory research of national education legislation.
