Road Traffic Safety Law of P.R.C, which has been enforced since May 1st 2004, puts forward in its General Principles the strategy of "socialization on road traffic management and safety propaganda", and definitely requires that, "socialization is carried out in the vehicle-safety-technique-examination and during vehicle-driver training". Nevertheless, Socialization of Road Traffic Safety Management (SORTSM) has neither been playing its due role, nor has been treated in a proper manner. Therefore, it is of critical necessity to identify its concept, to analyze its current practice problems and find out their causes, to draw the outline of road maps of realizing SORTSM.The whole dissertation is composed of seven parts:The first part, Introduction. In the past long time, our country has been attempting to solve the severe traffic problems by focusing on improving road traffic management levels, but from the point of System Theory and social characteristics of road traffic, the socialization work which is based on specialization should be strengthened. Though this has been recognized, there are few profound studies.The second part, Definition of SORTSM and its Legal Value. Road traffic safety refers to the untouched status in which the human beings and property and other lawful authorities remains well from the very beginning to the end of traffic participation. Generally speaking, road traffic management can be divided into such three parts as traffic safety management, traffic efficiency management and traffic environment management. To improve the traffic efficiency is the highest pursuit of road traffic management.SORTSM is referred to the mechanism and process in which the road traffic police department led by Government and coordinated by other related operating divisions, together with active social power, manage to create the orderly, unblocked, safe traffic and produce least public hazard and least energy consume.Generally, only those works which are of social characteristics and can not be managed solely by road traffic management authority can be regarded as socialization areas. SORTSM connects closely with socialization of administration management, police work, public security, public safety, hazard prevention and privatization of police work, scientific management of road traffic safety. It embodies such law values as preventing disputes over trifles, improving executive environment, ensuring the fulfillment of management measures, boosting the democracy cause and solving the problem of lack of police force, etc.The third part, Inevitability of SORTSM. The serious traffic problems of our country are derived radically from the under-developed economy, failure to perform their respective duties of the government and its operating divisions, misadministration of managerial personnel and restrictions from current legal system, managerial system and society. Therefore, the only outlet to solve the severe traffic problem is to develop SORTSM which is based on specialization and economy development. SORTSM is not only regulated by our country's laws and regulations, but also testified by the consensus of foreign legal and executive practicers. Furthermore, it has been a custom for the social power to participate the road traffic management. In one word, SORTSM is inevitable for the development of road traffic management.The fourth part, Positive Analysis of SORTSM. Problems in both the legal system and practice, which are caused by lagging-behind legislation and limitations of laws and regulations, imperfect managerial system and deficiency of public participation, can only be solved by proper legal control, managerial system reconstruction and cultivation of public participation.The fifth part, Legislation Control and Managerial System Reconstruction of SORTSM. We should not only remedy the defects of our current laws and codes, but also constitute Administration Contract Code, Administration Direction Code, Administration Procedure Code, Road Traffic Safety Education Code and Implementing Rules on SORTSM. We also need reform and perfect the current road traffic safety management system, including the initiation of Ministry of Traffic Safety, the reconstruction of public security management system which is controlled all over by Ministry of Public Security. We need establish the responsive system of road traffic safety management and reticulation organizations of SORTSM.The sixth part, Direct Outlet of Realizing SORTSM. Without public participation, without SORTSM. The public participation needs the support of Public Participation System. To foster the public participation system, we should stick to step-by-step principle, diversity principle, etc. Corporation participation should be paid special attention, the foundation of traffic safety propaganda organizations by social power should be encouraged, volunteer service should be advocated, road safety associations and organizations should be set up in all trades and all kinds of enterprises, public institutions and agricultural departments, armed forces and armed police forces.The seventh part, Conclusion. It points out that SORTSM only provides a kind of mechanism, embodies a kind of management process, and supplies possibilities of realizing management objectives. Only through handling dialectically the relations between socialization and specialization, through straightening out the relations between the police and the public, between the police & public and road traffic safety management, can we create harmonious road traffic safety situation.
