A Study On The Citizen's Legal Belief In The Process Of Rule By Law In Our Country

That ruling a nation legally and constructing socialism country of rule by law has been put on the paper of Chinese Constitution. Then the governing idea of rule by law was established in our country. The whole society has taken great effort to construct the country of rule by law under the leadership of Communist Party of China and we have obtained the amazing results. For example, the law and regulations have been gradually consummatted. But the law is not to be equal to the rule by law. Facing the present situation of law that judicial corruption, people ignore the rights and administrative authority suppress the law, we had to admit that our country is still far away from the society of rule by law. Legal belief is the basement and precondition of the society of rule by law. The degree of the legal belief decides the development of the society of rule by law. The formation of the society of rule by law needs the firm belief in the law. But in our country, the citizen doesn't know the legislation well, the law nihilism exist universally, the law losts the supremacy, and the legal belief don't have the approval of the people, all the facts show that Chinese citizen lack of the legal belief seriously. And it becomes the main factor for restricting the construction of the state of rule by law.The article studies the basement theory of the legal belief through three aspacts including the concept, the integrant part as well as the type of the thoery. Firstly the article proves it the citizen's legal belief has huge impetus to the construcion of rule by law in our country. Then the article analyses the reason that makes the citizen lack of legal belief from the aspacts of politics, culture and economy. On the basement , we take effort to find the right way that is helpful in formation of our citizen's legal belief in order to promote Chinese construction of rule by law. Considering the present situation of our country's rule by law, the writter believes that we can take measures to raise the citizen's legal belief through two aspects including the subject and object of legal belief. Says specifically, in the aspect of the subject of legal belief, we should strengthen their right consciousness and legal consciousness, deepen their legal value feeling and approval, and raise their spirits in obeying the law. In the aspect of the object of legal belief, we should take a scientific mode to legislate and enhance the quality of the legislation products, enforce the law strictly and establish the supremacy of the law, and make the jurisdiction fair and set up the authority of the law.
