Chinese government has been paying great attention to formulating and executing industrial policy since the 1980s. For many years, industrial policy has played an active role in regulating China's industrial structure, improving the quality of industrial organization, and thereby promoting the transformation of the mode of economic growth. However, there are some problems; for example, industrial policy lacks scientific theory because it is drawn up by the government without the restriction of laws. Moreover, some industrial policy is not effective due to the lack of mandatory and binding force of laws. So it is an important factor for the execution of industrial policy to apply to laws. According to some experts, one of the reasons for the successes of Japan's industrial policy is to make it into law. Each Japan's industrial policy is stipulated in the form of law, which makes Japan's industrial policy stable, successive and procedural, so that Japanese entrepreneurs can predict the future situation accurately. Chinese current economic situation is similar to that of Japan during the period of rapid growth. On this basis, we can compare industrial policy laws in both countries to draw on the experience of Japan's industrial policy law and to find out the problems in our industrial policy law and improve it.After the Second World War, Japan has become an economic powerful country. Japan experience four stages of development and regulated industrial structure three times, which made Japan have advanced industrial structure. The essential reason was that Japan carefully planned and formulated specific and operational industrial policy according to market mechanism. But after the 1990s, Japan suffered from bubble economy and experienced a decade of the Great Depression, during which a lot of new problems appeared, such as long-term deficiency of demand, softening investment, aging economic structure, and so on. Among the fundamental reasons, industrial policy law made a great difference. To sum up, there are successes and lessons in Japan's industrial policy law and both will help us perfect our industrial policy law.Using the historical materialism method and the comparative analysis method, the author analyzes China's and Japan's industrial policy law and suggests some advice about improving China's industrial policy law,on the basis of describing the basis theory of industrial policy.This thesis includes four parts:In part one, the basic theory of industrial policy and industrial policy law, the author discusses the basic theories of industrial policy and industrial policy law, and analyzes the relationship between them, which underlies the comparison of China's and Japan's industrial policy law in part four.In part two, the analysis of China's industrial policy law, the development of industrial policy and industrial policy law are discussed with three periods involved, that is, the period of planned economy, the period of transition from planned economy to market economy, and the period of market economy. According to the analysis, the author finds out the successes and problems of current industrial policy law of China.In part three, the analysis of Japan's industrial policy law, Japan's industrial policy law in different periods is analyzed—the period of Japan's economic recovery, the period of rapid economic growth, the period of stable economic growth, the period of regulating economic structure and the period after the 1990s. The author summarizes its successes and lessons.In part four, the comparison of China's and Japan's industrial policy laws and the perfection of China's industrial policy law in New Era , the author compares industrial policy laws in both countries, and on this basis, gets some inspiration from Japan's industrial policy law. Meanwhile, the author makes some suggestions to perfect our industrial policy law under the circumstances of China's current legislative status and background.
