In 1946, The World Health Organization for the first time wrote the right to health in the charter of the World Health Organization:"gaining the highest attainable standard of health is a basic human right". From a constitutional point of view to study the right to health, protecting the right to health has become a global trend. The right to health does not include all health-related matters. It only means that citizens who are in the normal condition of the body and spirit, have the right to be given national health care. The government is the main subject of obligation to protect citizens'rights to health, and has the duty to make full use of all resources and provide necessary health services to citizens for the realization of their health. The right to health is a constitutional right, and a growing number of countries have confirmed the right to health as a basic right in their constitutions. The state has the main obligation to constitutionally protect citizens'rights to health. To protect the right to health through the constitution and to prevent the illegal intrusion of the public power,"writing the right into the constitution" should be the first step, state organs'complying with the constitution is a necessary requirement and the establishment of unconstitutional censorship is the key measure.
