In our country, E-commerce is presenting the booming trend. Its speed of development, influence, and superiority is obvious. But, we also should notice that as a kind of new transaction mode, e-commerce brings huge economic benefits while it also threatens the protection of consumers' rights. How to protect consumers' rights and cultivate their confidence becomes a key question on the promotion of the development of E-commerce.This article takes the problems of the protection of consumers' rights as research's object, discusses on how to definite and protect consumers' rights. It also refers to laws and regulations, policies and guidelines of international organizations and analyzes a case by using legal theories to build up the legal system of the protection of consumers in E-commerce in China. The article also makes some proposals about the protection of consumers in E-commerce in China, such as the security of digital payment, the protection of fictitious property in network, the protection of consumers' privacy, fraud in network, format contract in Internet, unthreading digital commodity, and jurisdiction, etc.The article first feature from the start e-commerce, e-business from the special circumstances, China's e-commerce on the consumer need for the protection of the rights and interests.The second part gives the e-commerce consumer protection elements, and then mainly from the consumer's right to know, security transactions, the right to privacy, the right to return aspects of the area of e-commerce in need of special protection of their rights.The third part, concise introduction to the e-commerce in foreign consumer protection of the rights and interests of the state of legislation and summarize them for our country to learn advanced experience of learning.Papers final chapter of the previous analysis of the text, based on legislation, law enforcement, Relief and channels for China's e-commerce consumer protection measures proposed.
