It is the essential function of prison that can't realize without the financial security to prison funds. For a long time, the question has been trouble the function because of the lack of guarantee about prison funds, and some local cause serious issues of executed the law. The Prison Act formally promulgated in 1994 had been regulated that government safeguard all demands of funds about reforming criminal. As a result, people customarily quoted the rule of Prison Act in research; they had not deeply research the origin of theory. In fact, because government had burdensome task on state construction, local finance limited, and the relevant department haven't been formulating detailed regulations accordance with the Prison Act, and the prison carried out management system combining the prison with enterprise, it has been difficult to safeguard prison funds fully by finance. In the end of 2003, the reformation of prison system officially started in six provinces, and the state proposed overall target that full security, dividing enterprise from prison, separating income from expenses and standardizing operation. From reformation of real situation, the level of financial guarantee of the province units have been raiser than past .Because not considers to the factor of different regional economic level, rising price and changing related policy, the recently financial guarantee is still in the low level. Consequently, under new situation of building harmonious society, the relevant department and local management of prison appeal to establish dynamic guarantee of prison funds as soon as possible according to the scientific concept of development.Few people research that finding proper theory to improve the ideal, and make the problem to get more attention and support. This article focus on that introducing public accountability to the problem of prison funds, avoids considering it only from aspect of the Prison Act. By defining prison concept under public accountability theory, elaborating prison funds, character of prison funds and relationship between prison funds and the essential function of prison that further proves prison funds should be safeguarded by government finance. Finally, this article proposed the guarantee mechanism of prison funds under the harmonious society and relevant measures by analyzing the status of prison funds guarantee, main issues and reasons.
