Study On Carrier's Liability In International Air Cargo Transporttation

As one of the important part,international air cargo transportation has always been a controversial area.How to determine the carrier's responsibility are the most important elements to resolve international disputes.This paper,based on a brief introduction of "Warsaw convention" and the 1999 "Montreal convention", through international cargo transportation related concepts and the carrier's liability analysis,specifically explained how to identify carrier's responsibilities in connection with related cases.Finally,some targeted comments and suggestions to the status of China civil aviation in cargo transportation are proposed.There three chapters except introduction and conclusion.Chapter 1 chronologically introduced the development of international aviation private law from 1929 "Warsaw convention" as the core,"Warsaw system" to 1999 "Montreal convention".briefly introduced the international cargo transportation related concepts,which distinguished the goods, luggage and mail,the concept of the contract of international cargo transportation,which distinguished the carrier,shipper and consignee obligation,and also introduced the changes in the transport documents,a brief analysis of the documents as an important evidence in air cargo.Chapter 2 which introduced the international cargo carrier liability system,as well as related question research.First of all it differentiated concepts of related carrier.Secondly it introduced responsibility principle of the carrier,analyzed similarities and differences of carrier responsibility principle attribute to "Warsaw convention".And also the carrier's liability was introduced,related references on how to identify the carrier's responsibility were provided.Chapter 3 proposed to improve the thought of our country's air cargo carrier responsibility system,in the introduction to our country's air cargo transport carrier's liability,with the relate case,our country's air cargo transport carrier's liability related issues were discussed;Finally on the basis of two sides in legislation and policy,to complement China's air cargo transport carrier's liability comments and suggestions.
