Construction Of Legal System On NGO's Participation In Public Crisis Management

In modern times,it has been a big unavoidable challenge to the society that public crisis happens too often.When talking about public crisis, people will immediately think of the conflict and the oppositive nature between public power of the government and private rights of citizens,and then the urgent application or even the abusive use of administrative power may occur to people's mind.This idea is based on the traditional thought of the counteraction and balance between the public power and the private rights.As the supplier of public service and administrator of public affairs, it is true that government should take a dominant role in the management of public crisis,however,the potence and resources of a few emergency governmental department is far from enough.Through introducing non-government organization(short for "NGO"),which is an important part participating in the management of public crisis in contemporary society, this article is in the pursuit of promoting the development and growing up of the civil society by ordinating the relationship between government and citizens and by facilitating their cooperations.In this paper,the concept of public crisis,the use of a comparative study of empirical research, historical research and theoretical studies of methods,from management, sociology and economics research,in the light of the traditional private and public law of the relevant theory,from Western developed countries,nongovernmental organizations to participate in public-art crisis management system,proof of the defects of China's relevant legislation and institutional deficiencies.
