The Research On The Consummation Of The Nomination Of The Nominee Of The Grass Root People's Congress

The Nomination system of the representatives, a main aspect of the People's Congress System, including the fairness and democracy of the nomination process and the effectiveness of the nominee, directly affects the efficiency of the People's Congress System and the democratization of our country. This essay, though the research on nomination practices of those cities with out district divisions, the divisions directly under the cites, counties, autonomous counties, villages, nationality towns, and towns, mainly focusing on nomination process, seeks to expound the nomination system of the representatives, tries to explore the deficiency and limitations of the process, and propose the possible measurements to regulate the grass root election and to consummate the nomination system. Though the resolution of these problems, the nomination process would be more open and predictable; the common would enjoy more rights of election; the delegations would be more effective; and consequently the election would be smoother.This essay is divided into four parts:The first part is about the content of the grass root election. After the forth amendment of the Election Law in October 2004, more and new legitimate insurances are provided. More specific regulations would tremendously improve the election works. The details are included in the following passages. The second part tries to expound the history and existing practice of the nomination of representatives from grass root. Beginning with the amendment of the Election Law, the nomination system is significantly influenced by the revision and the four amendments of the Election Law. Generally speaking, the nomination system, changing in accordance with the Election Law, has been improved. And thence increase the democracy dissemination.The third part focuses on the main problems and the origins of those problems. The problems are mostly in lacking of the democracy in the election process, shorting of regulations in the nomination works, the incompatibility of the nominees and the violation of the Election Law. The origins of the problems are mainly in the four parts: the over-generalized provisions of the existing laws; the historical side-effects; the misunderstanding of the nomination work; and lack of effective oversight mechanisms.The forth part seeks to provide some ideas to regulate and improve the nomination works of the grass root representatives. Firstly, the nomination needs to be opened to common people and regulated by laws. Secondly, the consummation of the candidates needs to referenced to the foreign practices. Thirdly, the competition should be imported into the nomination. And lastly, the supervision system is needed in order to superintend the process.
