Direct election is the starting point of the democratic politics, as well as one of the characteristics of the modern political civilization. A high-quality election will create the true democracy, while a low-quality one will result in nothing but the superficial democracy. The procedure of the nomination is so decisive that it will directly determine the direction and the result of the election. However, objectively speaking, legal rules on the procedure of the nomination in the Constitution and other laws of our country are far from integrity, there are lots of problems in practice, so it is quite necessary to do some further study on it.This dissertation chooses the nomination procedure as its research object, enumerating all of problems in this procedure and then analyzing them. By studying the relative provision about the procedure of candidate nominating and defining, the development of those provision and popular practice of election work, the author analyzing the problems of those provision and electing practice and their reasons. Then through studying foreign relative theory and useful experience in practice, the author also discusses how to reflect the democracy and the real will of the law in modern election laws better so that we can choose the deputy whom can really stand for people's benefits.This article includes introduction and 3 chapters:The introduction talks about the motive of this article, present research about the nomination proceure in direct election, the structure, the research method and new ideas of this article.In the first chapter, the author talks about the general knowledge of the nominating procedure in direct election, including its importance, history and present situation.The second chapter is the most important one, and in this article the author divides the nominating procedure into 3 stages: the nominating stage, the introducing stage and the stage of defining the candidates, and then points out problems in each stage: First, at candidate's nomination stage, we don't have a unified standard to carve up the election zones, we usually provide the rigid structure of the deputy's rate and the number of deputies, and we usually pay much attention to the organization's candidate, but underestimate the joint candidate of electors. Second, at the candidate's introduction stage, introduction of the candidate is not objective and comprehensive, and it's difficult to come into the communication between the constituencies and candidates. Third, during the course from the preliminary to formal candidate, while the legal provisions are too fuzzy, the phenomenon of electing under the table by Legal loopholes is very serious, therefore the voters have many complaints to this.In the third chapter, to solve the problems mentioned above, the author suggested: (1)carving up the election zone reasonable, which carving up the election zone by residential area and adopting the small election zone system step by step; (2)regulating the qualification of candidates; (3)stipulating the procedure of candidates applying and nominating which means establishing the candidates applying system and canceling the provision about the rigid structure of the deputy's rate and the number of deputies; (4) perfecting the candidates introducing system and introducing competition mechanism into election; (5) consummating the way of preselecting.
