Research On The Issues Of Recall Of Rural Grass-root Election

Rural area promotion of democracy at the grass-roots level is a significant issue in the process of democratic politics building in our country, and the villagers' democratic election is the first link of rural area promotion of democracy at the grassroots level. The rural electors'right to recall is the expansion to the rural's election ,which also is a particular form in the procedure of election ,therefore it has a very important significance to study and inquire the issues originated from the rural's election and recalling in our country. In the vast area of rural regions in our country ,the institution of electing and recalling remains in the immature stage ,all sorts of new issues and old issues leaved over from the past coexits, all these not only have seriously hindered villagers performing their right to elect and recall but also to the construction of rural grass-roots democratic institution. This article analyze historical developing process of valligers'electing and recalling,the characteristics and the resources to cause the electors'conduct in our country ,at the same time having made a little investigation and discussion, on this basis I put forward some superficial ideas on how to solve issues take placed in villager's electing and recalling.Full text is divided into four parts:Part I is the discussion on the historical developing process and its characteristics to villagers'electing and recalling in our country. Firstly, this part explains the implication of the villagers'electoral recalling , analyses the historical developing process and characteristics on the villagers'electing and recalling in our country, expounds the significance of the villagers'electoral recalling .Recalling is the expansion of electing, the right to recall is the sequence of the right to elect, is the protection to the right to elect, the realization of rural grass-roots democratic election depends on the practice of the right to the villagers'electing and recalling .Followed the propelling of rural grass-roots democratic building, most villagers have posed further demands to self-government by law ,their demands on recalling some unqualified village commissions meeting members is becoming strong increasingly .Since "Organic Law of Villagers' Commissions " took the institution of recalling into the clauses of law in the year of 1998, the villagers'electoral recalling from not being valued by the practical field and theoretical field to the practice of self-government by villagers, and has been taken into the consideration of theoretical study. With the successful performance of the villagers'electoral recalling, the depth and validity of self-government by villagers has been made a great promotion, which ensured the self-government by villagers coherence and integrity .However, after the practice of recalling in several years, although the performance of the institution on villagers'electoral recalling has attained gratified achievement, the current situation is not optimistic. Although every province, municipality, autonomous region have carried out explanation in details and innovation on the recalling institution on the base of the situation in the local districts according to the villagers'electoral recalling, the practice of performance on the institution of recalling is still beset with difficulties. In reality, the participation to the recalling of villagers is enhancing, but recalling conducts often shows the characteristics of multi-times, the recalling frequently following with the group appealing to the higher authorities for help behavior, furthermore, the conducts of villagers'recalling shows non institution, easily elected, difficult recalled has became a generally phenomenon.The second part initiates a discussion on the resource of villagers'electing and recalling .There are three facets to initiate the resource: problems relevant to villagers'vital interests; problems with the construction and performance of villager's commission; problems with the operational benefits of villagers'commission. In many circumstances situations, the reasons that members of villages'commission be recalled lies in that they don't do well in many jobs ,such as in the finance public, the collective enterprise manage, the land take over for use, the homestead construction, the birth control, the fee in labor cost and so on, as a result ,the villagers'commission have not been able to let the villagers be satisfied. Moreover, many villages'representative assemblies cannot on time be convened, the village commission cannot do the periodic report work, promptly not be able to answer villagers' question and satisfies villagers' request, there lacks essential communication between the villagers' commission members and the villagers ,also it is extremely difficult to investigate the village cadre's work responsibility .The village commission is not able to create the benefit or not to create the good benefit to all villagers when they are in official period initiates a series of questions, has caused the election recall behavior appearance.The third part is a discussion on the main questions about villagers'electoral recalling. This part mainly analyze many issues involved in the institution and procedure on recalling of villagers'elect, reasons to recall, administrative behaviors of higher authority government and how to deal with the contradictions appear in the process of recalling. In the practice of recalling, there exits issues with villagers'conference convinced and presided, the way of recalling is unitary, the procedure of recalling owes the standard. Laws and regulations relevant to the institution of recalling remain lots of imperfect facets, there adulterated multitudes briber behaviors in the process of recalling. Furthermore, all kinds of practices to the phenomena are beyond people's satisfaction. There also appeared other contradictions in the process of recalling, whether or not dealt well directly relates to the right of villagers' recalling smoothly to be realized.The fourth part proposed measures to solve the villagers'recalling. In order to deal with all sorts of issues appears in the process of the villagers'recalling well, to make the institution of villagers'electing and recalling perfectly, we must strengthen the system of regulation, strengthen the construction of institution on recalling procedure, harmonize the relations between town's government and communist committee. Strengthen the supervision to the villagers'electing and recalling, put an end to the bribe behaviors in the course of electing, make a effort to avoid intensifying the contradiction in the course of recalling, strengthen culture's construction in rural area, educate villagers to get the consciousness of right on recalling, make a good soft environment to perfect the institution of villagers'electing and recalling in our country.
