Reserch On Legislative Regulations Of Medical Expemses In China

In recent years, medical expenses are on constant rise. As a matter o f fact, they have increased at a faster rate than National Income. The high price of medical treatment has become a heavy burden on the vast majority of citizens. In reality, medical expenses include the cost of both medicine and diagnostic fee. What are the causes of high medical expenses? Lack of sound and effective legal regulations is the key factor. However, current medical legislation is far from perfection, which greatly weakens the legal regulations within medical field. In view of what is mentioned above, this dissertation tries to explore the concept, futures and current situation of medical expenses, based on economic law, administrative Law and social science.The dissertation consists of five parts:Part I introduces the concept of medical expenses by defining medical practice.Part II illustrates the necessity of legislative regulations of medical expenses by probing into the social problems caused by the high price of medical treatment.Part III sheds some light on the legislative regulations in China by exploring how it works in some developed countries, such as US, Germany, France and Japan.Part IV by illustrating and analyzing related legislation, states the insufficiency of legislation for medical expenses. For example, there are no medical price standards, and it lacks regulations on the cost of medical service.Part V gives suggestions on how to perfect the legislative regulations on medical expenses by analyzing the feasibility and principles of legislative regulations in our country, conceiving of the framework and finally addressing the construction of legal responsibility system.
