Consideration For The Improvement Of The Labor Dispatch Legal Regulation In China

As a new labor pattern of a kind of non-standard labor relationship, Labor Dispatch has been developed considerably because of its widespread applicability in various Countries since it came into being. After it was introduced to our country, it has played a vital role increasingly as well for its fitness to the special national conditions background of China.The Labor Contract Law of China was decided to be set up On June, 2007 and has been come into force formally since Jan.1st, 2008. There is a special chapter in the Law that regulates the Labor Dispatch which improves the situation of legislation lack in this aspect in the past. However, there are many discussions and controversies among the academia and practice circles since its enforcement.From the concepts, properties, causes and the theoretical foundation of legal regulation, this paper aims to investigate the current development situation of Chinese Labor Dispatch legal regulation, deep analyze the existing defects of the present Labor Dispatch legal regulation and try to provide some personal suggestions to the improvement of the existing Labor Dispatch legislation of our country from several aspects.
