The Research On The Supervision Of Labor Dispatch In The Implementation Of The New "Labor Contract Law"

Under the background of the new "labor contract law", from the perspective of government supervision, Shanghai labor dispatch as a case study, we found that a large number of new type of labor outsourcing in Shanghai, Shanghai is also the first proposed "labor outsourcing" city, with a certain representative, at the same time, the relevant laws and regulations are not perfect, so that China’s actual supervision of the operation process, there are many problems. This article hopes to find out the main problems in the process of labor dispatch supervision by the analysis of the government to find out the reasons for the difficulty of supervision, and put forward the feasible suggestions, in order to solve the problem of labor dispatch supervision, and effectively solve many problems of China’s labor dispatch, and to promote the stable and healthy development of China’s labor dispatch industry has a certain significance.The writing style of this paper is to use the research method from the phenomenon to the essence, from the problem to the solution. In detail, the article is divided into five parts: the first part will describe the foreign and domestic government’s supervision over labor dispatch. The second part describes the implementation of the new "labor contract law", the Shanghai labor dispatch as an example, the current situation of Shanghai labor dispatch and the government’s supervision of the situation. The third part is to find out the problems in the process of the supervision of labor dispatch in Shanghai. The fourth part analyzes the reasons of the problems in the process of supervision. The fifth part puts forward the countermeasures to improve the supervision of labor dispatch.Through the research, this paper considers that the new "labor contract law" in the implementation of labor dispatch supervision problems mainly include:(1) the labor dispatch service outsourcing regulatory standards is not perfect;(2) labor dispatch service outsourcing has the difficulty to make supervision more difficult;(3) the tax department of labor outsourcing tax supervision is not perfect.In view of these problems, this paper puts forward the countermeasures to improve the supervision of labor dispatch:(1) the improvement of labor dispatch supervision standards;(2) to establish the distinction between labor dispatching and labor outsourcing;(3) to improve the tax supervision.
