Voluntary service originated from religious charitable services in western countries in the early 19th century, and voluntary activities have already existed and developed more than 100 years. In the early 1990s, the China Youth Volunteers Association established. In recent years, with the social progress and development, volunteers participating into the field of services gradually increased, from the initial stage to the boom of the voluntary service. In contrast to the past, the content, time and clients of the voluntary service have tremendous changed, the volunteers serving different areas have different characteristics and legal status.This article has three parts, The first part of our volunteer the origin of the obstacles encountered in the development of voluntary service and the urgency of legislation to set up and analysis the. The second part talks about the most representative of several volunteers. They are volunteers serving for the large-scale competition or conference, volunteers serving for the unspecified people in the city (of which are divided into city management volunteers and convenience service volunteers), volunteers serving in the community, volunteers serving for the special activities as the governmental large-scale activities and emergency services. I have analyzed the definition of these volunteers separately, their rights and duties, and the problems of these volunteers. The third part of this article points out that we have not built comprehensive laws and regulations to carry out and improve the work of volunteers. Before the legislation across the country, I have advocated that a unified national voluntary service law should contain the following main elements: First, volunteers and voluntary service organizations can contract with their objects, which determines their rights and obligations; Second, set up voluntary service fund by legislation, and prescribe that government-funded and social contributions are major sources of the fund; Third, for a long time, volunteers in our country have been managed by many departments, and therefore we should form a unified volunteer organization and legal norms as soon as possible; Fourth, the national legislation should focus on setting up a unified mechanism of volunteers assessment, evaluation and award.
