Volunteer service is derived from religious charity of the Occident, which is an important social welfare activity in the 19 th century. With the development of globalization, the career of volunteer service is gaining its popularity and acknowledgement all around the globe. From the 1990 s, volunteer service has been growing in C hina, playing a very significant role in Chinese social and public utilities. No matter when in the Beijing O lympic Games or in the Lushan Earthquake, volunteers in C hina and other countries had swayed their sweat in grand meetings as well as the disaster areas. Volunteerism has been thoroughly emerged by the selflessness and dedication of volunteers who have made great contributions to social stability.To protect the rights of volunteers and to ensure the orderly operation of volunteer service by legislation has become a common perspective worldwide. In China, thirty-four provinces or municipalities have made their own local laws and legislations, a majority of which have defined the relevant concepts of volunteer service, summarized the qualifications of volunteer service organizations and volunteers and preliminarily crystalized volunteers’ rights and obligations. Nevertheless, C hinese volunteer service is facing kinds of problems, in the meantime, many realistic issues are impeding the progress of volunteer service legislation.Through reading literature and contrastive analysis, this paper makes definitions of relevant concepts of volunteer service and their legal ne xus as well as analyzing what achievements and questions we have got from volunteer service legislation, and brings forward countermeasures depending on the foreign experiences. To begin with, it defines the concepts of volunteer, volunteer service, volunteer service organization, volunteer service objects and volunteer service law, along with showing the significances of C hinese volunteer service law. Secondly, on the basis of summing up the achievements, the paper generalizes the disadvantages of C hinese volunteer service legislation, such as lack of consolidated legislation, inconsistent qualifications of volunteers, deficient volunteer interest-security, precarious financial sources and shortage of regulations of volunteer services abroad. Then, by colla ting the volunteer service laws of America, France, Germany and Japan, it extracts their legislation experiences, which comprising consolidated legislation, ample financial sources, assorted tax-policies together with volunteer interest-security. In conclusion, this paper puts forward three countermeasures to improve our volunteer service law —aim and principles as a basic, unified legislation as a support, specific legal systems as an ensurance.
