Water is both an economic and ecological natural resources and indispensable to human. As China's industrialization and urbanization process accelerates, water pollution has increased, the contradiction between water demand and supply has increased significantly. How to resolve the contradiction between supply and demand of water resources,improve the utilization of water resources, achieve the optimal allocation of water resources and to realize sustainable use of the water rights system as a solution to vested water rights has become a serious social problem. effective means and measures to achieve the optimal allocation of water resources and sustainable use, such as water allocation, water rights transference , and the state macro-control campaign issues, are the most powerful system of protection. This paper focuses on the concept of water rights and its nature, law relationships, the relevant distinction between the related rights, the status quo and experiences at home and abroad and the acquisition, transference, security and other issues .It is hoped to put forward some references to improve China's system of water rights.Chapterâ… is on the brief account for water rights. The author demonstrates some academic views for water rights ,gives definition for it and makes a study on the nature, property of water rights and differences between water rights and the ownership of water resource and other related rights.Chapterâ…¡is on the introduction of water rights systems in main countries and their good experience. First it introduces the foreign water rights systems and their features as well of the United States , Australia and Japan, then analyses water rights systems of mainland and Taiwan as well as their status and defects; finally analyses abroad experiences for China and the significance to establish a scientific and sound system of water rights.Chapterâ…¢is on the legal relations for water rights. It analyses the main body, the object, the content, esp. focuses on the content of water rights and its different kinds.Chapterâ…£is on the legal relationship changes. It analyses some legal changes, such as: concept, principle, condition of water allocation and water rights transference, the reasons of eradication of water rights as well as security guarantees and the realization of water rights and so on.
