Legislation Necessityity And Framework Of Xinjiang's Legislation In Agricultural Circular Economy

Since China's reform and opening-up to the world, Xinjiang province has made tremendous progress in the economy with improving comprehensive economic strength, mainly relying on its rich recourses and the implementation of new-style Industrialization and Industrialization in Agriculture. However, it can not be ignored that Xinjiang has paid off great costs in resource and environment. As for the present situation of Xinjiang's legislation in agricultural circular economy, this paper tries to analyze and study, in a comprehensive way, the necessity and framework of agricultural circular economy, so as to perfect the legislation system in Xinjiang. With that precondition, stress in resource and environment will be released; eco- environment in countryside will be improved; income of farmers will be increased; the development in Xinjiang's economy and society will be sustained.Structurally, the paper can be divided into three parts.The first part analyzes and demonstrates the legislation theory in agricultural circular economy. In this part, the general term of the legislation theory in agricultural circular economy is the rules for the economic activities such as decreasing the whole process of the resource investment on agricultural product, production output, production consumption and produciton disuse, recycling and converting into resources and so on. Through the analysis of characteristics, basic principles and modes of agricultural circular economy, the conclusion is drew that with the theory of agricultural circular economy as the guideline, Contraposing the chararteristics of reclycles of agricultural production, advanced scientific technology, coherence of the colligate profit, people participating, economic benefit colligating and ecotype of agricultural activities. To make clear the value target of the legislation theory in agricultural circular economy is to advance the justice and equity of society development, achieve the unification of ecology and benefit.The second part analyzes the necessity of Xinjiang's legislation in agricultural circular economy. From the economic and political analyse for the advantage and drawback of agricultural economy development combining with the present requestment of agricultural circular economy in Xinjiang, the conclusion is that, this legislation is not only necessary, but also workable. For one thing, to ensure the increase the income of people in Xinjiang and protect the stability of society system, it should be make good use of the national laws for the support to legislation in agricultural circular economy in Xinjiang. For another thing, more importantly, the Power of Autonomy in Law of the People's Republic of China on Regional National Autonomy should be studied. On the basis of that, the relative laws and regulations which suit for the Xinjiang's particular circumstances can be made, in the hope of sustainable social and economic development.The third part is to design the framework in the legislation. After the close study of western countries' experiences on the agricultural sustainable development, and analyses of China's present legislation, this section finally offers the legislation framework.In this section, the principles of theagricultural circular economy in Xinjiang are to boost the development on agricultural circular economy, to increase the the efficency of utilizing the agricultural resource, to protect and improve the agricultural ecology enviromnet, to realize the agricultural sustainable development. Embodying the tenets and basic principles of agricultural circular economy in Xinjiang which are insisting on the agricultural sustainable development, exerting the colligate function of agriculture, paying attention to the regulations, especially perotecting the people's legal right.
