| Since the Chinese economic reform, the electronic information industry in China has been developing at a high speed. The income of sales, the industrial added value and the total profit keep the double-digit growth. On one hand, the development of industry brings the considerable economic benefit. On the other hand, the extensive mode of economic growth also brings a huge number of resource and environment problems. Circular economy is an important way of realizing the harmony of industry development, resources and enbironment.During the process of developing circular economy, legislation is a necessary way. However, at this moment, the legislation of circular economy in China is still at the exploratory stage. There're many problems which haven't been solved. And there are several key problems of the circular economy laws of electronic information industry to be solved, such as the systematic framework, the responsibility distribution and the realization mode.At the first step, this article analyzes the whole life circle of electronic information products by the method of Life Cycle Assessment (LCA) and finds the necessary law items of circular economy of electronic information industry. At the second step, the article compares the better legal systems of circular economy in other countries, such as Germany and Janpan, with the situation of laws in China. Combining with the result of LCA, the article concludes the systematic framework of the circular economy laws of electronic information industry.According to the analysis of legal relationship and main body of legal relationship, the main body of legal relationship of electronic information industry circular economy laws in China should include producer, importer, seller, consumer, government, individual of recycling and disposal, etc. The article uses analogism to compare the distribution of legal duty at home with that at abroad, and then draws on the conclution that our country can use the method of cost allocation to solve the problem of the cost brought by recycling and disposal. At the same time, every main body of legal relationship should undertake relevant behavior duties. Otherwise, consumer, producer and government should undertake some safeguard duties.In the last part, the article uses questionnaire method to analyze the demand of the circular economy laws of electronic information industry and designs a new pattern of Extended Producer Responsibility which is based on it. According to the situation of our country, the pattern marked by direct participation, information and producer responsibility organization is a feasible realizing pattern of EPR.The conclusion of a case study of electronic information industry in this article can be extended to the electronic and electrical products manufacturing industry which has a bigger range and also can be refered to use in other industries. |
