Circular Economy Producer Responsibility Extended Studies

In the 21st century, China's resource shortages and environmental degradation have become increasingly prominent. Recycling economy development model to subvert the traditional extensive mode of production, which the reduction of resources, reuse, resources as the core, is to solve the shortage of resources and retain sustainable development. In order to promote the development of circular economy, resource-saving society, China in January 2009 launched the first "Circular Economy Promotion Law", as the laws in our country is still in its infancy, its contents are mostly guidance, promotion and incentives requirements.Implementation of the strategy of circular economy needs to match the responsibility system. The traditional division of responsibility for the manufacturers border lack of power products for recycling and binding. "Circular Economy Promotion Law," Chapter XV provides for extended producer responsibility system, the system is that it reasonable to extend producer responsibility to the product disposal stage, after which producers can effectively promote the products from the whole focus on the life cycle, improve product design and production processes, and re-organize the way they operate, and promote recycling after waste products, thus promoting the development of circular economy. The formal establishment of the system in our country soon, its provisions on the principles of the drawbacks of limited, the compulsory recycling directory also need improvement.This article is based on circular economy development model, by drawing on foreign experience, to further explore the system of extended producer responsibility context, development of the process, problems, responsibilities subject, object, content, and recycling system and litigation mechanisms. I hope to make effective recommendations to improve the system of extended producer responsibility implementation.This paper divides into four chapters. The first chapter is the elementary theory, divides three parts. The first part is the producer responsibility extends system's connotation and the core. The second part is the difference of producer extends responsibility and the product liability, in order to tell people how to distinguish the producer responsibility and other liability system. The third part is the producer responsibility extends system's rationale. The author from the environment power, the product life cycle, exterior aspects and so on internalization theory elaborated this system's rationale.The second chapter discusses the economy on extended producer responsibility recycling system-oriented functions. It divided into three parts, the first part describes the concept of circular economy and its principle. The second part discusses the relation of the ystem of extended producer responsibility and recycling economic, pointed out that the circular economy on extended producer responsibility system-oriented functions, extended producer responsibility system is the protection of circular economy.The third chapter is divided into two parts, the first part is about Sweden, Germany, the United States, Japan, the EU's system of extended producer responsibility legislation and the implementation of a comparative study. Writer summarized its characteristics for our reference. The second part describes the system of extended producer responsibility legislation and implementation of China, and list the existing problems. Depend on the foreign comparative research and analysis of the situation of our country, the writer can raise improvement proposals in the fourth chapter.The fourth chapter is extended producer responsibility in China's construction and perfection. In the first part of the system, writer defined the extended producer responsibility system, the main responsibilities, content, implementation of the object, recycling system and litigation patterns.
