Study On The Legal System Of Extended Producer Responsibility Of Our Country

Solid waste pollution has already become one of the four major public hazards with water pollution, air pollution, noise pollution. There is a big consumption of resource and energy in our country, which results in produce of enormous solid waste. In recent years, "Law of prevention and cure of solid waste polluting the environment", "Law of clean production promotion" and etc has been regulated successively, but the amount of the solid waste still increases continuously, and the environmental pollution caused by solid waste is becoming serious day by day, which leads to great waste of resources at the same time. This paper examines a policy mechanism known as extended producer responsibility as an important regulatory policy instrument in the developed countries. In "EPR", a producer's responsibility is extended to the whole life cycle of product, especially the post-consumer stage. The "EPR" can provide producers with impetus to develop "Circular economy". The amount of solid waste is rapidly increasing in China, and the tendency is still going on. So it is necessary to perfecting waste pollution legislation. Under the background, it is important to study the meaning of "EPR". Compared with more perfecting EPR system, our country hasn't the explicit and perfect rules about this.This article is divided into totally four parts to analyze that "EPR" is very important for our country, and it gives some suggestions to establish "EPR" in our country. The first part says the origin and the theory basement of "EPR", by analyzing the process of "EPR" to testify it is necessary to building "EPR". The second part introduces the related legislation and practices of "EPR" in foreign countries in order to find the direct way of "EPR" in our countries. The third part through the view of Solid waste pollution to analyze the present and many problems of "EPR" . From both the outside tendency and the inside state of Solid waste pollution, "EPR" is the necessary safeguard for the economic sustainable development . The fourth part tells how to build "EPR" that is suitable for our country on rule's level.
