| The majority of China people live in the rural area..The fact of small average ownership of land is the basic condition of China.For most agricultural people,the rural housing site is the most important property except the arable land.But during past years,because of public ownership system of socialism of our country,housing support is always the value orientation of the law maker.The agricultural people can live on the rural housing site,but they have no right to deal the usufruct of the rural housing site.For the past thirty years, market-oriented economy has been established and been developing well.Everything is marketized,even the land in the rural.Whether in theory or in real life,the transfer of the right of land is an inevitable trend.However,current laws have not covered the new situation. Current laws on the rural housing site are few,unclear and lagging.So the trades on the rural housing site are running out of orders.Because of the concern on agricultural people,I choose this subject.This paper is mainly about the transfer of usufruct of rural housing site.For the Rural Housing Site is a particular concept in China,I try to define this concept and conclude the features of it.During the inspecting of the history of transfer of usufruct of rural housing site, I try to find the value orientation of the lawmakers of that time and try to sum up some valuable meanings for nowadays.After inspecting the current situation of the transfer of usufruct of rural housing site and the causes of formation,I analysis the merits and faults of current laws.And at last I try to give my own suggestions on the transfer of usufruct of rural housing site,which is established on the new value orientation of law-making. |
