Research On Judicial Remedy System Of American Domestic Violence

Domestic violence has been attached great importance to international community, which is one kind of behavior easily neglected and infringed in the world. The United Nations has issued a series of specialized conventions on regulation of domestic violence, such as Declaration on the Elimination of Violence against Women, A Framework for Model Legislation on Domestic Violence, the Practical Measures on the Elimination of Violence against Women in the Field of Crime Prevention and Criminal Justice and so on. States have formulated the corresponding provisions on domestic violence from the perspective of domestic law.Judicial remedies against domestic violence in USA are realized from three main aspects. First of all, civil remedy means that the civil protection orders are issued to the victim. Secondly, criminal remedy, it means that the congress formulates and implements the system of mandatory arrest, mandatory prosecution system and other related means of relief measures in order to protect the victims of domestic violence. Thirdly, administrative remedy, it means that the U.S. government establishes the shelters for victims of domestic violence and sets up an Anti-anger Center for Male and other relief measures to ensure that the human rights of the victims can be realized.In view of more difficult prevention and treatment of domestic violence in China, it is necessary for our country to learn from USA's legal system on domestic violence relief in order to improve our country's system of domestic violence relief on the basis of our country's real situation. It is natural to put forward some suggestions such as establishment of the system of civil protection orders, establishment of a mandatory reporting system for medical personnel, establishment of networks for multi-agency collaboration to combat domestic violence and so on.
