Reflections On The Water Pollution Control Legislation In Construction And Comprehensive Reform Of "Two-type" Society Pilot Area Of Chang-Zhu-Tan

Water is the source of life, human survival and development of the city can not be separated from water. Water is an important guarantee to achieve sustainable development in modern society. With the rapid development of social economy and the people's living standard continuously raise, the problem of water environment is increasingly serious, environmental legislation has become an important means to control water pollution. In response to the new situation of worsening water pollution, Water Pollution Control Act changes timely. At present, Chang-Zhu-Tan city group has been approved as the "Construction and Comprehensive Reforms for National Resource-conserving and Environment-friendly Society Pilot Area" , (referred to as Chang-Zhu-tan "two-type" society pilot area), and the water pollution control of Xiang River basin has become the primary object at this stage of building "two-type" Society.Xiang River connects with Chang-Zhu-Tan city group, and crosses the urban areas of three cities from south to north. At the same time, Xiang River is the common source of drinking water and the water body for accommodated pollutants in Chang-Zhu-Tan city group. So the protection of Xiang River is directly related to building Chang-Zhu-Tan "two-type" society and sustainable development of the whole basin.The area of Xiang River Basin in Chang-Zhu-Tan city group is more than one third of the area of Xiang River Basin in Hunan province. If water pollution control work is just objected to the Chang-Zhu-Tan region, rather than from the perspective of the whole basin, then it is difficult to solve the water pollution problem in Chang-Zhu-Tan city group. Thus, in fact, the settlement of water pollution problem in "two-type" society pilot area of Chang-Zhu-Tan is to solve the water pollution problem in Xiang River Basin.There are many reasons which cause the water pollution in "two-type" society pilot area of Chang-Zhu-Tan, but the defects of the legislation is the main reason. The water pollution control regulations for "two-type" society pilot area of Chang-Zhu-Tan, especially the Water Pollution Control Ordinance of Xiang River Basin in Hunan Province (referred to as the Ordinance ), have many problems, such as the legislative purpose, the supervisory and managerial system, legal system, and legal liability. Therefore, in view of the serious water pollution in "two-type" society pilot area of Chang-Zhu-Tan, we should hold on the correct principle of legislation, and perfect the water pollution control legislation about two-type society pilot area of Chang-Zhu-Tan, especially the Ordinance, by way of correcting the purpose of legislation, improving the supervisory and managerial system, perfecting legal system, strengthening the legal responsibility.
