On The Improvement Of Chinese Legal Systems Of Corporate Environmental Social Responsibility

The activity of enterprises is one of the main causes of environmental problems.For solving environmental problems from the source,it is significant to research and improve the relative legal systems of corporate environmental social responsibility.This dissertation consists of four chapters.Chapter one defines the concept of corporate environmental social responsibility at first.Then it clarifies theoretical basis of that concept from the aspect of environmental ethics,social interests and the internalization of externalities.At last,it points out that assumption of that responsibility is essential in practice for enterprises to develop circular economy,to participate in international trade and to develop themselves.Chapter two reviews relevant statutes of the United States,Germany,Japan, including enterprise environmental information disclosure,environmental public interest litigation system,and so on.It concludes that assumption of corporate environmental social responsibility needs both supervision and impulse,which should be guaranteed by perfect legal systems.Chapter three examines relevant legislative doctrines and present legal systems in China.Present legal systems take the "economic man" hypothesis and end-pipe treatment as legislative doctrines which are not helpful for enterprises to assume environmental social responsibility.Then it introduces and analyzes present legal systems from three aspects,including enterprises' interior management,supervision and impulse from government and supervision by public participation.Chapter four makes recommendations to improve relative legal systems by changing legislative ideas and specific rules.As to legislative doctrines,it is necessary to introduce the theory of sustainable development,the concept of circular economy and the "ecological man" hypothesis.As to specific designs of legal system,to guide enterprises to strengthen their internal management needs to improve systems of enterprise environmental supervisors,extended producer responsibility and environmental accounting,to strengthen the supervision and impulse by government needs to adopt enterprise environmental information disclosure system and government green procurement law,and to establish environmental public interest litigation system in order to guarantee the public's supervision on enterprises' behavior by justice.In short,enterprises can be impelled to assume environmental social responsibility by improvement of legal systems on three levels,including enterprises,government and the public.
