As the backbone of the state-owned economy, state-owned enterprises embrace crucial social welfare and have an irreplaceable role in all aspects of social production. Meanwhile, state-owned enterprises also play an indispensable part in dealing with social emergencies. The special status of state-owned enterprises makes themselves not only shoulder the responsibility of making profits, also take on more social responsibility. But, based on current Company Law of the People’s Republic of China, the provisions on corporate social responsibility are still in principle, which lack operational functions and are likely to cause the company acting on its own ideas. Even in the eyes of many companies, social responsibility is regarded as a kind of morality. Only after severe accidents happening, do the company take certain measures to rescue the losses. Because of staff’s improper operation, the explosion of Petrochemical Company of Jilin occurred and triggered off a series of environment and security issues, which pose a great loss to the country and people. Pursuing the reasons, state-owned enterprises do not have a sense of corporate social responsibility, neglecting staff training, lacking of specific preventive measures to prevent environmental pollution. The punishment from certain government is far from satisfaction and cannot make the state-owned enterprises to pay attention to social responsibility. Thus, such accidents cannot be prevented from happening. Therefore, how to explore the social responsibility of the state-owned enterprises from the legal point of view is the focus of this study. Based on this issue, the paper includes four parts:Chapter1:Combined with the explosion of Petrochemical Company Jilin,the study primarily covers the social responsibility of the state-owned enterprises, and proposes controversial focus of the case.Chapter2:Researching several problems caused by the explosion of Petrochemical Company,Jilin,this chapter mainly concentrates on the concept, the characteristic and the nature of corporate social responsibility of the state-owned enterprises. Meanwhile, the analysis of special aspects of state-owned enterprises shouldering the responsibility is also covered.Chapter3:By analyzing the successful practices of other countries in the aspects of corporate social responsibility, combined with the setbacks of the social responsibility of state-owned enterprises, this chapter mainly covers the real need to learn from the experience and lessons.Chapter4:This chapter focuses on in-depth analysis of the lack of social responsibility of state-owned enterprises in China, and in accordance with the explosion of Petrochemical Company Jilin, several issues is covered, such as staff training issues, safety issues, the issues of responsibility relief, supervising issues, and the introduction of the report of state-owned enterprises’social responsibility. Moreover, punitive damages in environmental tort, environmental responsibility insurance system and other related systems are also introduced in this section.
