Research On Introducing Bribery Crime

As at type of corruption crime,bribery has become increasingly rampant in modern society.In recent years,"Introduction Bribery" crime keeps appearing.The condition of the introducer brings the briber and doodler together and facilitates them is not fresh and its role has become increasingly important.At home the study on introducing bribery crime is not comprehensive enough.China's criminal law legislation regarding bribery crime is not perfect,lack of systematic,all bribery charges loose contact of the legislative provisions,the judicial practice of law often have different interpretations of Article.The study is on the whole system point of view of bribery to analyze,in-depth analyze the theoretical foundation and the main basis for its independence.The paper is concentrated on elaborating the difficulties and emphases with some typical cases,pointing out the distinction and contact with the easily confused crime in order to accurate the bribery,the article attempts to make a few points last.The paper is composed of introduction,text and conclusion,the main text is divided into five chapters.Chapter 1 introduces the dispute on retention and the abolition of the crime, which is divided into two parts.First introduce the concept of bribery,domestic and foreign legislation relating to the status of introduction;Followed introduce the retention and abolition on the idea of bribery,elaborate the necessity for existence at the present stage.Chapter 2 penetrates the four elements of bribery constitute elements of the lens,in order to accurately grasp the assumption of bribery.Chapter 3 combined cases,research the difficulties and emphases in the judicial process.The fourth chapter uses abroad for reference,combined with the reality of our country to propose domestic legislation in the foregoing analysis.
