The Investigation Report On The Protection Of Peasant-workers' Labor Rights In Linyi, Shandong Province

The peasant-workers are the special group which emerged and formed in the transfer of surplus labor force from countryside to the city since the 1980's. Now, they become a very important part of the second and the third industry. However, from the status, they are still the farmers because their registered permanent residences are in the countryside. The nonuniformity leads to the unequal treatment to the peasant-workers in job and other aspects. Their labor rights can not be protected. In this thesis, we can explore the protection of status quo by investigating labor rights of peasant-workers and then we can put forward some useful suggestions.This thesis can be divided into three major parts.The first part is the summary of the achievements in the protection of peasant-workers labor rights in Linyi, Shandong Province. It's mainly reflected in three aspects: First, the protection of employment rights is better. Employment restrictions are decreasing and the proportion of the signing of the contracts has been greatly improved. Second, the right level of compensation has increased. The peasant-workers' situation of arrears, unpaid wages has changed. Third, many factories have trade unions and a great number of peasant-workers join in the trade unions.The second part is the summary of the problems about the labor rights of peasant-workers in Linyi, Shandong Province. First, formal employment training institutions are lack. Second, their registered permanent residences are not the dwelling places. Third, the overall wage is not high. Four, the right of rest and vacation is difficult to protect, as well as the right of health and safety. Five, the level of social security is low. Six, human rights organizations have failed to play its due role.The third part is the summary of the measure about labor rights of peasant-workers in Linyi. First, the relevant systems should be improved, including the reform of the exiting household registration system, improving the mechanism for job training of peasant-workers, mechanism for labor dispute and improving social security system. Second, law enforcement should be strengthened. Third, the trade unions should be strengthened. Four, peasant-workers should improve their own qualities.This thesis is a investigation report, the thesis first analyzes the protection of labor rights of peasant-workers in Linyi by a large number of detailed data and specific cases. And then the thesis finds that achievements and problems both exist. At last, the thesis puts forward some propositions in order to improve the labor right of peasant-workers in Linyi, Shandong Province.
