The peasant-workers are the special social group which emerged and formed in the transfer of surplus labor force from the countryside to the city since the 1980's. According to the state statistical bureau, at present the peasant-workers population in our country has already surpassed 200 million. Our dual division system of city and countryside leaded the nonuniformity of their occupation and status. From the occupation, the peasant-workers no longer are the farmers but the workers engaged in the second and the third industry, however, from the status, they are still the farmers because their registered permanent residence are also in the countryside. The nonuniformity leads to the unequal treatment to the peasant-workers in job and other aspects, and their legitimate rights and interests can't be protected. In recent years, the scholars in sociology have discussed a lot about how to solve a series of problems the peasant-workers faced, but the legal circle has paid attention insufficiently. This thesistries to probe further into the right to work ------the most serious problem in theirrights protection from the legal angle.This thesis can be divided into three major parts:The first part is the summary of the peasant-workers and the right to work. Firstly, this part gives the definition of the peasant-workers. Secondly, this part discusses the right to work from the concept, the quality and the content comprehensively. Finally, this part discusses the significance of protecting the right to work of the peasant-workers, pointing out it is the intrinsic request of the human rights, the request of observing the international labor standards and the embedded meanings of the socialist harmony society.The second part is the present situation and legal analysis of the peasant-workers' right to work. Firstly, this part describes the present situation of the right to work of the peasant-workers from nine concrete aspects ,such as their right of employment is seriously harmed, their right of payment is damaged, their right of rest can't be guaranteed, their right of working safety and sanitation is flawed, the right of special protection for the women workers and the underage workers doesn't realize, their right of occupational training is difficult to be guaranteed, their right of social security is seriously flawed, they can't receive prompt relief when their right to work is invaded and their protecting organization is absent.
