Legal Protection For Citizen's Social Security Right In The Context Of Harmonious Society

Construction of socialist harmonious society is a great strategy addressed by CPC in new era,which is used to settle social contradiction, stabilize social order,fulfil equity and justice.Harmonious society should be achieved through feasible and practicable approach,in modern society, the need of social development and the attribute of law itself decide that law control is the essential way to achieve society harmony and construct harmonious society.Social security is one of systems for constructing harmonious society,the functions of social security depend on fulfillment of this system.It is a promotion to construct protection system of social security right for harmonious society.The right to social security is those rights that shall be asked to offer under laws by people when people's income cannot maintain necessary living levels or normal living standard because of old age,illness, disability,unemployment,bearing,death,calamity,poverty,temporarily or permanently there being no competence or opportunity of work.It is not only a kind of social fundamental right that a series of international human right laws confirm and secure,but also a constitutional right most country's constitutions have confirmed.But achievement of constitutional rights must be assisted by other systems,so social security right is realized and protected by legislation,administration,jurisdiction in china.As far as legislation is concerned,the defects refer to no unified law system and low efficiency,there is no integrated social security law system in china.In the field of administration,it also has some problems, including no perfect administrative organizations,indefinite legal status of organizations,restricted sources of social security funds and fault supervision systems.In the context of jurisdiction,there is no special organizations and programs for the disputes of social security.It also needs to be promoted in the aspects of litigations and some regulations.In order to solve these problems,some measures and paths must be developed in future.In legislation,we must focus on the construction of integrated social security legal system.Meanwhile,problems such as legal values,principles and model need to be made clear;In administration,under the direction of socialism,we must do our best to construct unified social security organizations and supervision systems. Broaden the sources of social security funds is also important;In jurisdiction,special organizations should be constructed to settle disputes.
