Recently, Smoking Ban Movement is popular in the Europe. Globally, people acknowledged the necessary of Smoking Ban. In traditional legal science, the law focused on the citizens'behaviors which had social meaning, and the law regulates the social relations. The environment law regulates the environments social relations, and the relations should have the feature of will, occur in the action directly relationed with natural object and be in the range of potency of the environment law. Based on the smoking behavior and the social relations it arosed, they should be regulated by the environment law.Establishing and perfecting the environment law for smoking ban are necessary. First, smoking is harmful, and many dreadful substances are in tobacco smog. Those substances cause stimulus, cancer and poisonous effects. Second, passive smoking or second-hand smoking is especially harmful. In China, at least 500 million people are falling victims of second-hand smoking. Third, tobacco smog is a huge pollution to the atmosphere, especially the indoor.The environment law for Smoking Ban is feasible. Firstly, from the view of legal economics, the tobacco market, including production, manufacture and consumption, needs the government to intervene. Secondly, the development of smoking ban globally shows the feasibility of the regulation. Thirdly, from the domestic investigation about smoking ban in the public, it is a popular idea that we should forbid smoking in the public. Moreover, it can be concluded that the environment law for smoking ban is acknowledged at certain range and feasible, based on the poll in Hangzhou and Beijing.The present laws should be modified better. The environment law for smoking ban is all-leveled covered. The author thought about the regulation of Hangzhou and it of Beijing microly, found their advantages and defects. Overlooking the period of full-scale smoking ban, the author conceived three transformations, which are from smoking ban in the public to ban in the private, from tobacco industry to ecological agriculture, from no smoking to nobody smoking.At last, the author came to the conclusion. Smoking ban belongs to the range of the environment law. Smoking threatened the smokers, passive smokers and the atmosphere, so we should regulate it. From the view of legal economics, the state should intervene the tobacco market. There are many regulations for smoking ban in international society, and domestic analysises also illustrate the feasibility. After research on two typical regulations, the author believed that smoking ban in public sites is urgent and feasible, and the present law should be perfected. Till now, full-scale smoking ban's conditions are premature in the long run.
