Legal Control Over The Network Violence

Nowadays,the network society keeps changing.All that we need to do is to make the legal system about network adapts the social reality as soon as possible.But the network violence is one of the by-products.As a hot social situation,the whole society has been paid an increasing concern to it.There are many manifestations of it,two of which are mainly emphasized.One is the language violence of the network,which is the people use malicious words to attack or belittle other people.The other is the people who impose the violence use the internet search engine to find out the network virtual people in the real world and disclose much of his personal information.This is what called "human research engine".Network violence,especially the "human research engine" is the newest product of society.Though it is lack of statutory provisions now,I am sure there will be specialized legal provisions about it in the future.Besides,as Roscoe Pound said,although the law is the main means of social control contemporary,we also need the control from other means,such as morality and religion.In fact,the reason of network violence is the users disagree with something on morality,and they want take the moral judgments instead of legal judgments. As a result of it,people on the internet use keyboard and mouse as weapons to attack other persons.Only we use comprehensive means can control the network violence effectively.This article mainly uses methods of sociology of law,with psychological analysis, comparative analysis and typical cases analysis together.Take the "human engine research" as an example to give some research about the meanings,reasons and features about network violence.Besides,by considering the psychological factors of the person who imposes network violence,to discuss the possibilities about legal control on network violence and "human research engine",so as to have a comprehensive understanding of the phenomenon of network violence objectively and fully.This article is more than 42,000 words,and is divided into six parts:In the introduction,the paper indicates the central issues of this paper and discusses the status quo of the network violence as well as the research the meaning of this research.Chapter 1 begins with the discussion of the "human research engine",and gives it a definition.Also concludes the meaning and reasons of network violence.Chapter 2 introduces the development of the network violence and the social problems it brings about.Then describes its features,which is different with other conclusions.Chapter 3 discusses the "human research engine" from a law-sociological view.The "human research engine" infringes personal privacy,and brings conflicts between morality and law.But the legal system and other regulatory means are not effectively enough.Chapter 4 gives some methods,of legal control about the phenomenon of network violence,especially the "human research engine".The network violence reflects the conflicts and contradictions between virtual network space and the real world.Because of the lack of legal provisions at present,we need legislation urgently.Conclusion part points out that the law comes from the reality,so the legal control of the network violence should not only on the means of legality,but also depends on the regulations of morality and religion.Only when the laws comply with these standards,they adapt to the society.
