A Study On The Legal Problems Of Eco-labeling System Under WTO Framework

In the past few decades,the economy of world has been rapidly advanced by the globalization of trade,when people enjoy the material achievements,they are also arising from the tremendous environmental pressure.In the "environmental era",the problem of trade and environment has been more and more widely concerned by the international community.The largest trade organization in the world—World Trade Organization(WTO) is more concerned about environmental protection,it has added the contents of environmental protection in its trade rules.Eco-labeling system as a new trade-related environmental measure,it has both economic and legal characteristics,it adapts to the needs of sustainable development,it also contributes to the coordinated development of international free trade and environmental protection,however,eco-labeling system is at a developmental stage under WTO framework, many of the relevant rules aren't consummate,need to be further deepen and clear,which result a series of problems.With a new round of WTO negotiations on trade and environment,eco-labeling system as an important topic,its future development trend is more and more clear.As the largest developing country in the world,China has joined the WTO,the foreign trade is facing unprecedented opportunities and challenges,studying the rules and practices relate to the eco-labeling system under the framework of WTO become particularly important. In the new historical context,Chinese eco-labeling system has many shortages,these problems must make a negative impact for Chinese foreign trade,how to improve Chinese eco-labeling system and consistent with the international standards is becoming a serious problem.This article started with analysis the rules of eco-labeling system under the framework of WTO,combined with the problems caused by the eco-labeling system,revealed the future development trend of eco-labeling system,with a view to make some contributions to Chinese international free trade and environmental protection,and make Chinese eco-labeling system could develop along the track of law,to achieve the overall coordination with Chinese economic growth,environmental protection and social progress.
