The Research Of Chinese Tourism Law's Legislation

Tourist industry has already become a fast developing and prospective new industry in the world. It plays an important role in the world economy. Since the 1990s, the tourist industry gets rapid development and becomes one of the greatest industry in the world. After the reform opening-up, the tourist industry has achieved great developments, and occupied great proportion in our economy. However, the legal system concerned with tourism still falls behind. Although the related governments have set up some concerned tourist laws and documents, which have contributed greatly to our tourist developments, construction of tourist law has some lagging. After China joins WTO, it is necessary to consider how to deal with such problems in the field of tourist market. The resolution will necessarily profits trades abroad and realization of tourist powerful country and enforces the position in overseas trade system. Just under such background, we should strengthen law construction in our country, tourist law coordinated with WTO in our country.The first part of this thesis analyzes the ordinary category of Tourism Law. And this part also analyzes the quality of Tourism Law, the relation of Tourism Law. Then it defines the Tourism Law of this thesis.The second part of this thesis is mainly about the survey of Tourism Law abroad. For the limit of the space, this thesis just analyzes World Tourism Organization (WTO), Tourism Bill of Rights, General Agreement on Trade in Services, the Tourism Law's legislation of Japan and the Tourism Law's legislation of Thailand. By analyzing the legislation of Tourism Law abroad, we can get some experience from it. And that behavior is useful for the Tourism Law's legislation of China.The third part of this thesis depicts the existent problem of China's Tourism Law's legislation, with focus on the legal system concerned with tourism still falls behind and inadequate.The fourth part of this thesis expatiates on the necessity and feasibility of China's Tourism Law's legislation. This part primary comes down to the necessity and disadvantageous effect comes from the lag of China's Tourism Law's legislation then discusses the qualification of China's Tourism Law's legislation is mature.The fifth part of this thesis introduces the meditating of China's Tourism Law's legislation. Learn experience abroad, intergrades theory with our practice, we meditate the legislation of China's Tourism Law. We try to investigate tourism Law's legislation's pattern of China, the appellation of China's Tourism Law, the tenet of China's Tourism Law and the regulation's range of China's Tourism Law.
