| The villager's voting right is the right the villagers have to elect the grassroots mass organization of self-government, which is called the villagers committee, based on the villager's identity according to the Constitution and the Organization Law of Villagers Committee. In recent years, the number of disputes in the village elections has a rising tendency. There are so many illegal activities violating the right in the village elections and they have become a threat to the village self-government system. Where there is a right there is a remedy. When the villager's voting right is infringed, there should be a water-tight mechanism to protect it. However, according to the current legislation of our country, the mechanism is not perfect, and the most prominent performance is the lack of the relief of proceedings. Due to the lack, there are a large number of electing violations in reality, which cannot be promptly corrected, and they infringe the villager's voting right seriously. In the modern society, the relief of proceedings plays an irreplaceable role, and it is the last way to protect the right, because of the relief of proceedings has legitimacy, authority, thoroughness and impartiality. Therefore, it is imperative to set up the relief mechanism of proceedings to protect the villager's voting right. At the same time, it is fit for the spirit of our constitution to set up the mechanism to protect the villager's voting right and the practical conditions is ready. We should be initiated in two parts to set up the relief mechanism of proceedings to protect the villager's voting right. In the short-term, we should revise the organization law of villagers committee and three major procedural laws so that the villager's voting right will be included in the proceedings. In the long-term, the villager's voting right can be relieved on the full ranges through establishing a special electing tribunal to accept these cases, and setting the special proceedings.
