Contrast Research On Some Problems Of Province's Election Statute Of Villager Committee

The institution of villager self-governance, which has been carried out in rural China, evoked changes of governance pattern, and also brought far-reaching effect on China political development. But the practical execution of The institution of villager self-governance can't turn out as it wishes, institution designment is not reasonable, institution designment can't catch up with the institution execution, which are both the directly reasons despite the reasons are very complicated. So perfecting and innovating to The institution of villager self-governance is very necessary, the first measure we should take is perfecting and innovating to The institution of the electing of the villager committee, because only villager committee has been elected correctly, we can discuss the institution of villager committee. This is the basic theory premise to this paper.The paper contrast analyzes the 31 provinces' statute on villager committee election, emphically precisely analyzes 3 problems in following aspects :the constituencies enrollment, the stipulations on the villagers' committee candidate, the recalling of the member of the villager committee, points out the similarities and differences, advantages and disadvantages, then correspondly brings forward legislation propose. After the analyzing to above paragraphs, I find that there are many sameness and repletion in Provinces' election statue , the differences often are good measure and should have been applied in whole county, because of Provinces-decentralization legislation ,this good measure can not be extend the other province .So the author think that Provinces' decentralization legislation do not reach the center legislature's aim: adjust measures to local conditions , contrastly it bring on legislation confuse, which does not be avail to the unification of the country's legal .At last, the paper attempts to summarizes democratic practice inChinese rural areas, and, on the basis of practice and the constitution and other laws, intends to construct a practicable and relatively comprehensive procedure of village committee election and incorporate it into the socialist legal system of P.R. China.
