Studies On Rules Of Origin In China's FTA Practice

Since the last decades witnessed the enormousness step of the integration of global economy and international trade,the protection to domestic industry by tariff has dramatically undermined by reduction commitments of related parties.In order to protect their domestic industry,more and more non-tariff measures have been employed by states.Rules of origin(以下简称R.O.) in FTA are widely launched to protect the security of economy and politics,but there is little effort focusing on the subject in contrast to many concentrating on R.O.in China recently.In consideration of the significant importance of the R.O.in FTA and the rareness of the research,this thesis makes full use of the experiences of the enactment of R.O.in NAFTA model and PAN EURO model at first;and then creatively generates three models,in accordance with the characteristics of R.O.in China's FTA practice;finally puts forward a blueprint of R.O.in China's FTA practice on the basis of remarks.This thesis consists of the introduction,three chapters,and the epilogue.Chapter 1 starts with presenting the inscapes of R.O.in FTA,focusing on the criteria.It establishes the theoretical basis of criteria of R.O.in FTA and comparatively studies three criteria,i.e.the criterion of Change in Tariff Heading Test,Value Added Test and Technical Test and points out their respective pros and cons.Then it provides positive analysis on the R.O.in NAFTA mode and PAN EURO mode,compares the strength and weakness of them via the inscape of R.O. quantitatively,in order to grasp same characters in the two classic models.Chapter 2 discusses and evaluates the R.O.in China's FTA by the foundation of three models of R.O.and poses the characteristics and deficiencies from the aspect of product-specific and regime-wide R.O..Chapter 3 puts forward proposals for their upgrading as well as the improvements of China in particularly,according to the deficiencies of R.O.in China's FTA practice posed above.
