Study On Civil Servants' Right Security System In China

The civil servants' right protection system is an institutionalized design to prevent violations of the legitimate rights of civil servants and to ensure the eventual realization of the legitimate rights of civil servants. It is an important part of both the civil service system and the human rights protection system. The Civil servants' right protection system includes three big parts of contents: the declaration on the civil servants' right of law, the preventive system of civil servants' right violated, and relief system of civil servants' right violated. Starting from the basic theory of the civil servants' right protection system, this article firstly focuses on the study about the current civil servants' right protection system of China after introducing the course of its history development, and then seek the path to improve the protection of the rights of China's civil servant system on base of the reference of historical and some western nations' useful experience. In order to make the points clear, this study is divided into four sections: Section One is on the basis of theoretical issues; Section Two briefly introduces the past and the current civil servants' right protection system of China, Analyses the defects and the reasons for the defects; Section Three contains comparison of the United States', France' and Japan's civil servants' right protection system., and summing up the characteristics and development trends of the civil servants' right protection system abroad to obtain helpful inspiration. Section Four, finally and most importantly, based on the above discussions, makes suggestions on theoretical innovation and changing people's concepts of remedy, on improving legal system and the actual operation of laws, on reforming the current administrative relief and establishing judicial relief system to let our civil servants' right protection system much more meet the needs of the development of the society.
