The legal protection of the rights and interests of the candidates is of great importance in the civil service examination system for it functions as a practical need to be considered not only in the civil service examination system but also in the maintenance of the citizen’s political rights, labor rights, and educational rights. However, due to the impacts the political, economic, and social environment have made on the employment of the candidates, critics have mainly focused on the civil service examination system and have not paid enough attention to the basic rights of the candidates. Given this phenomenon, it is particular challenging for the present author to make further exploration on the legal protection of the candidates’ rights and interests in the contemporary Chinese civil service examination both at a macro and micro levels with the case of Song Jiangming as an example.By means of reviewing the case of Song Jiangming, this thesis makes a detail analysis of the legal protection of the candidates’ rights, supervision of the examination and employment/recruitment system, and unfair regime in the administrative legal relationship within the framework of relevant articles of law. Besides, it fully illustrates about the legal protection of the candidates’ rights and interests in civil service recruitment. It is known that everything will not go smoothly. Although the existence of these problems will not deny the value of civil service recruitment examination system radically, these problems, to a certain extent, indeed severely prevent the pursuit of ideal effect in design of the civil servant recruitment examination system. Given the fact that these problems are not solved properly, they will even make negative effects on the whole system. Therefore, the present author will put forward some reasonable suggestions from three aspects:the rights and interests of the candidates, supervision mechanism, and functions of the recruitment agencies, hoping to be helpful for the protection of the candidate’s rights and the improvement of examination system.
