The Study On The Local Self-Government Legislation At The End Of Qing Dynasty And The Early Republic Of China (1908～1936)

Local self-government aimed for democracy and social development as an indispensable of the modernization of Chinese legal system since the end of Qing Dynasty. At the launching of local self-government exercise, the most prominent part is the activity of autonomy legislation—the system of which is well-established and sophisticated . The author's point of view from the legislative research, which may perhaps helpful for Chinese political modern development offer some lessons and enlightenment .This thesis is exactly form above these problems to commence, and the article is divided into three parts as followed: local self-government lawmaking at the end of Qing Dynasty, local self-government lawmaking of the early Republic China period, the inspiration for today.In the author's introduction of local self-government legislation , the first part is a brief description of the historical background and society's political structure of which is the local government activities of the end of the Qing Dynasty and the beginning of the Republic China, and followed ,the next part is by an brief introduction of the main self-governing laws and regulations which are promulgated by the government at that time, which are analyzed and studied in accordance with the logic system of self-governing region, the scope of the autonomy, residents and voters, self-government organs, self-government funds, self-government elections, and the autonomy of the supervisory.The research on this subject has very important academic value and some realistic meaning. At the third part of the thesis , through the analysis of the late Qing Dynasty and the early Republic China legislative activities of local self-government, the author proposed: The political setup reform of the present, can take in the precept from the history of the late Qing Dynasty and the Republic China local self-government failure , which at the same time draw lessons and adopt from the reasonable composition and the beneficial experience among the related system design, can knows for the reasonableness from the local self-governments more awake.
