When the new century comes, Chinese media industry blossoms rapidly. Thenews reports integrate into people’s life and become a window for the public to knowabout the all kinds of things of the society. The media play a role of supervisor inreporting the news. However, the society contradiction makes prominent when thesociety reform comes into the hard times in recent years. When reporting some hotcases, some media write the spot arbitrarily in order to attract the eyes of the publicand dislocate itself as the media supervisor, thus becomes the media trial, whichinterfere the judicature, and challenge the authority of the constitution and law.This thesis will use the method of logical analysis and system comparison to findthe cause and the great harm it may cause by the media trial. This article will learnfrom the development experience of Journalism law in England, America and Japan,and then raise some thoughts on the balance between media supervision and judicialjustice in the perspective of the Journalism law according the China’s specific nationalconditions.This paper consists of five parts except the preface and conclusion.The first part explains the importance of justice, then analysis of the significanceof justice, and makes further analysis on the specific principals to bring about thejudicial justice.The second part explains the reason and necessity of the media supervision. Thispart discusses media supervision role in promoting the judicial justice from thefollowing for respects: the loss of judicial authority, weakness of system supervision,the claim of right supervising power and the protection of constitutional rights.The third part discusses the harm of media trial, and analyzes the impact ofmedia trial caused to the normal order of society from the perspective of theinfringement the media trial caused to the justice and parties’ rights.The fourth part introduces the history of Journalism law development in England,America and Japan and the attempt dealing with the relationship between the mediaand the judiciary.The fifth part tells some specific practices on the balance between mediasupervision and judicial justice from three aspects according to China’s specificnational conditions.This part will make a clear carding depending on the differentsubjects.
