Equal employment right is a fundamental right stipulated by Constitution, which is a prerequisite for enhancing women's social status and achieving of equality between men and women. As for equal employment right, our country has established a preliminary legal system which is based on constitutional, including the laws and administrative regulations, departmental rules and regulations, local laws and government regulations, so as to protect and promote gender equality in employment. However, the current legal system has obviously insufficient on gender discrimination in employment, and poor practice , with little legal channels for relief, which led to women discrimination in employment is still widespread in our society.In this paper, firstly we introduce the labor employment and equal employment rights, define employment discrimination and gender discrimination in employment, put forward the legislation and deficiencies of women's equal right protection in employment under the existing legal framework. Through the survey of Chinese female employment status, we make a comprehensive and objective description of women discrimination problems in employment. We analyze the cause of current legislation problems in women's equal employment protection by means of Constitution, Labor Law and other related theories. Combination of international and foreign legislation, as well as Hong Kong legislation status , we conclude that: To improve women's equal employment rights' legal system, it must formulate Basic Law on anti-discrimination in employment , and improve judicial relief system and the relevant laws and supporting systems for women's equal employment right. By this way, we can promote women's equal employment and social harmony.
