The equal right in employment, which is one of the human rights, is important for women'living and development. Since the establishment of the People'Republic of China, lots of legislations have been made to ensure the women'rights in employment sphere. As the employment was controlled by the administration in a long term, we are short of the research about gender discrimination concerning employment and occupation. During the shift from planed economy to market economy , more and more problems were disclosed. Nowadays, the gender discrimination is reflected not only in employment, but also in training, income, and promotion, and so on. A few reasons are responsible for the female employment discrimination, but the insufficiency of the legislation system is above all.The first sector of this thesis describes the women's equality employment right. In the second sector, the serious gender discrimination in our country is accounted by real cases and a lot of digital resources. Furthermore, the causes and perniciousness are analyzed. The third sector introduces the industrialized countries and districts'legislations against gender discrimination. Through comparing these legislations with our concerning legislation, it is not far to seek the defects. The fourth sector is about the recommendation on Chinese law system against gender discrimination. In the last sector, the author tries to draw a conclusion.
