| It has not be changed that " the current news is not be protected by thecopyright law.since it was made in 1990. But about the definition of thetopical news, law fields and the press have never formed the common sense.What is the topical news? Article 5 of " implementing regulations of copyrightlaw " say "Topical news, refer to passing the simple fact news that suchmedias as the newspaper, periodical, broadcasting station, TV station, etc.report. "But the press usually understands the topical news into such reportsabout present political event or the social incident of news agency. Because ofthe regulation that " the topical news is not protected by the copyright law ",the phenomenon of media tort is outstanding day by day, having already upsetthe order of reporting of the press, to a certain extent, damage finallyaudiences' interests.This article will use law explanation method, comparative analyticalmethod, the case research and historical analytical method, etc., has probedinto the intension of " topical news ", especially international treaty ofrelevant legislation in the world, the legal norm of U.S.A., Britain, Germany,Japan, Italy, Taiwan,etc, through the contrast , find out the suitable place forconsulting . This text will introduce and analyze all sorts of reason that is notprotected. And analyze the protected urgency and possibility of " topical news" through media industrialization and argumentation of the news as acommodity. Offer making an inventory of our country about copyright of thenews legislation, point out the slip among them, and propose somesuggestions. Finally, protection of copyright of the topical news will beconstructed by "abandonment type " and " improvement type", the authorpropose adopting the latter, based on law stability.
